A gift to a colleague or customer in Türkiye can involve three different movements: value to a person, recipient information to a service provider, and a physical item across a border. Treating these as one approval invites an avoidable mistake. The Türkiye Ministry of Trade describes commercial import procedures by importer, goods and applicable controls; its separate notice about gifts carried by travellers concerns noncommercial personal baggage. The Personal Data Protection Authority (KVKK) sets out information duties for recipient data, while the Revenue Administration (GİB) quotes the income-tax law's broad definition of remuneration. None of those sources supplies a universal “corporate gift exemption.”

Decide what kind of transaction exists
Write down the business event before opening a catalog. An employee anniversary, customer thank-you and public-sector hospitality request may use the same physical item but call for different policy and legal reviews. Record the legal entity paying, the beneficiary and their relationship to it, reason, value or budget, recurrence, country of purchase, destination, funding structure and proposed delivery date. Finance should identify whether it is a staff benefit, marketing expense, client gift or another category in its own books. Procurement should not choose that category by looking at the shipping label.
Separate “invited,” “selected,” “ordered,” “delivered” and “accepted.” A budget reservation may not be a completed transfer of value. A fulfilled item may have a different value and date from a gift-credit invitation. Make the tax and payroll team state the event whose value it will review, the valuation evidence it needs, and the correction path if the recipient declines or the order is refunded. This is a controlled question list, not an assertion that all gifts create the same tax result.
Use one campaign key to join the approval, recipient eligibility, supplier quote, customs file and disposition record. Restrict who can see each record. A campaign manager needs fulfillment status; payroll may need a separately justified value and recipient match; a customs broker needs product facts and importer instructions. Avoid distributing an entire employee roster simply because several teams need one field from it.
Keep the passenger exception out of business-parcel planning
The Ministry's 27 June 2026 notice describes goods personally brought into Türkiye by travellers for personal or family use or as noncommercial gifts. Its passenger-value language belongs to that context. It does not turn a company order sent by courier to fifty employees into fifty duty-free traveller gifts. Nor does a low unit price settle whether a corporate parcel needs a declaration, tax, product permission or documentary evidence.
For a company shipment, begin with the Ministry's commercial import FAQ. It describes who may import, entry into free circulation, tariff classification and the product-specific documents that may be needed. Ask the importer or appointed broker to identify the actual route and classification, the product's origin and material, whether any restriction applies, the declared value, and who pays duties and import taxes. The correct answer may differ for two items in the same campaign. A domestic purchase avoids a cross-border import on that order but leaves the employer's recipient, tax, privacy and policy decisions intact.
Do not describe a courier's proposed simplified handling as an exemption approved for the campaign. Obtain written confirmation of its conditions and the party responsible for declaration. If the carrier says “gift” but cannot identify the legal import route, hold release, ask for a broker review, and change the route or product if the documentary burden is incompatible with the delivery promise. A deadline is a reason to decide earlier, not to omit a customs step.
Build the import file around the product and responsible importer
Before purchasing abroad, the operations lead should assemble a product description more useful than “corporate gifts”: material, intended use, quantity, model where relevant, manufacturer, origin, unit and total transactional value, and packing details. Customs counsel or the broker maps the goods to the applicable tariff classification, checks the current tariff and import measures, and asks whether permits, conformity documents or product-safety controls apply. The Ministry says documentation can differ by classification and the nature of the goods. A generic invoice template cannot answer that question.
Name the importer of record and the entity providing the commercial invoice. Reconcile invoice totals with the purchase order, packing list, freight charges, contract and shipment count. Where the business pays for a gift rather than selling it to the recipient, the broker still needs a defensible customs value and documented basis; “free to recipient” is not a reliable valuation method. The team should identify the party contractually bearing customs charges and how an exception is funded. Do not promise “duties included” until the proposal states what is included, estimated or passed through.
Run an exception rehearsal before inviting recipients. What happens if a unit is misclassified, a permit is missing, an address is incomplete or a shipment is held? Assign a person who may pause dispatch, a broker contact, evidence to request and a recipient communication owner. Acceptance is a reviewed file with product identity, route, importer, current classification assessment, document list and a signed ship/no-ship decision. If an item changes, reopen the assessment rather than copying the old classification.
Treat employee tax as a fact-specific finance decision
GİB's official material quotes Article 61 of the Income Tax Law: remuneration can include cash, in-kind items and monetary benefits provided in connection with employment. That is the starting issue for a Turkish employee gift, not proof that every gesture is taxable in precisely the same way. Finance and payroll must decide the actual recipient relationship, purpose, form of benefit, value, timing, documentation, potential exception and reporting under current law. We did not verify a gift-specific blanket exemption or a 2026 amount that can safely be pasted into a campaign rule.
A practical handoff asks payroll four questions. Which legal entity is the employer? What did the employee actually receive, and on what date? How is the value supported, including shipping or other bundled services where relevant? What does payroll need if the gift is not claimed, is exchanged, or is returned? Retain the decision with its source and reviewer, rather than writing “tax free” into an invitation. A client gift requires its own recipient policy, expense and any anti-corruption review; do not route it through employee payroll merely because both were in one purchasing batch.
Value and timing should be reconciled after delivery as well as approved before purchase. An estimate can diverge from actual product substitution, freight, country route or recipient choice. A reconciliation table should show budgeted, purchased, shipped, accepted, returned and credited states without silently treating these as identical. Escalate material differences to the original tax owner. Gift operations can supply transaction evidence; it cannot make the employer's tax conclusion.
Map recipient information before inviting anyone
A contact list is not a neutral shipping input. The recipient's name, work contact, delivery address, phone, choice and delivery status can be personal data. Under the KVKK information-duty explanation, the controller provides information when data are obtained: its identity, purpose, recipients of data, collection method and legal basis, and relevant rights. The duty persists whether the processing is based on consent or another lawful condition. Ask privacy counsel which controller and legal basis apply to the actual program; do not use a generic “consent covers everything” sentence.
Draw a data-flow map with the invitation sender, gifting operator, carrier, local importer and any overseas systems. For each step, specify a field, purpose, permitted viewer, retention trigger and deletion owner. Collect the home address only when needed for delivery, preferably from the recipient rather than an exported personnel spreadsheet when the chosen workflow permits. Offer a work-address or domestic alternative when it meets the program goal and reduces exposure. Limit notes about protected attributes, job performance or customer negotiations; a gift selection rarely needs them.
If recipient information will be accessed or stored outside Türkiye, add a separate transfer review. The authority's announcement of the Article 9 by-law and standard contracts reflects the amended framework and several controller/processor patterns. Legal counsel must assess the actual transfer and mechanism. A vendor's international presence, a privacy notice or a recipient's click is not an automatic substitute for that assessment. Record the mechanism approved, relevant parties, data scope and change-review trigger.
Put policy and recipient acceptance ahead of fulfillment
Tax and privacy approval does not decide whether a particular gift is appropriate. The recipient organization's policy, employment rules, public-official status, procurement relationship and tender timing may restrict acceptance. Ask the relationship owner to classify the recipient and check those rules before delivery. A low-cost item can still create a conflict in an active procurement decision, while a permitted thank-you may be acceptable under a documented policy. Do not invent a nationwide corporate gift cap from a traveller allowance.
Build a stop rule into the request form: unknown public-official status, live tender, government counterparty, restricted category, missing country review or uncertain importer means no automated release. Escalate to the existing compliance owner with the minimum facts needed. Keep the decision and approver visible to audit but avoid publishing the reason in the recipient message. A refusal is not a delivery failure to be “fixed” by reshipping to another address.
The recipient should be able to decline where feasible. State whether accepting is optional, who will see a response, and how a declined, expired or returned gift is handled under the program's terms. Unclaimed value may be reserved budget, purchased inventory or an issued credit; the Giftpack pricing FAQ says disposition depends on the commercial and campaign terms. Set those terms before the first invitation and reconcile the real state afterward. Do not promise automatic refunds or charitable redirection without the applicable contract and authorization.
Use one decision register across teams
A lean register makes the separate judgments reviewable. Each row should identify campaign and recipient category, route, item/classification owner, tax/payroll owner, privacy owner, policy reviewer, evidence version, approval date, ship decision and follow-up trigger. Avoid a single green “compliant” cell, which hides who decided which issue and when. The matrix below is an operating aid; it is not a legal classification for an actual item.
Table 1. Decision routes, responsible evidence, and release or recovery conditions for a Türkiye gifting program.
| Decision and route | Owner and evidence | Release or recovery test |
|---|---|---|
| Domestic employee gift | Employer finance/payroll value decision; privacy notice and recipient policy | Release after approvals; reconcile received, declined or returned value |
| Commercial parcel into Türkiye | Importer/broker product, classification, customs value, permits and charges; employer recipient review | Release only with documented route; hold or reroute when evidence changes |
| Traveller's personal gift | Traveller and customs adviser confirm noncommercial accompanied-goods facts | Never copy the passenger rule into a company courier shipment |
| Recipient data accessed abroad | Controller/privacy counsel maps parties, notice, lawful basis and transfer mechanism | Pause transfer until mechanism and data scope are recorded |
The register needs a change log, not only a final approval. A substituted SKU can alter customs and product safety; a new carrier or hosting location can alter data flow; a new recipient category can alter policy or payroll review. Require the request owner to reopen only the affected decision, preserve earlier evidence and stop the unapproved downstream action. At close, confirm actual delivered count, refused count, duties and taxes charged, credits and deletion work against the approved baseline.
Hypothetical decision one: a domestic employee milestone
Imagine a Türkiye employer planning anniversary gifts for 120 employees in three cities. The products are bought from a domestic supplier, while a campaign team outside Türkiye coordinates invitations. The first proposal says “no customs work, therefore tax-free.” The customs portion is narrow: this particular domestic purchase does not itself import a parcel. It does not answer payroll, data-transfer or employer-policy questions. The finance owner must classify the benefit and value under the facts, and privacy counsel must map whether the foreign campaign team or service provider receives employee data.
The program manager first receives a list of eligible employee identifiers, not home addresses. HR confirms eligibility and duplicate prevention; payroll asks which item or credit will actually be received and when. Procurement documents the domestic quote, product choice, who bears delivery cost and substitution policy. Privacy counsel approves a notice and the data flow before an invitation. Recipients who choose home delivery provide only the required delivery fields through the approved channel. Operations does not infer a legal basis from the fact that the gift is popular.
Suppose twenty people decline and a supplier replaces an out-of-stock item at a different price. Do not record all 120 as identical taxable gifts merely from the original invitation count, or assume the reverse. Preserve invitations, choices, invoices, delivery confirmations, refusals and supplier credits; send the changed facts to payroll for its decision. If the external campaign team was not approved for the relevant transfer, pause its access and use an approved domestic process while counsel reviews the route. The acceptance packet is the eligibility snapshot, tax and privacy decisions, actual supplier/recipient ledger, exception approvals and evidence of closure. This case is illustrative, not a customer result or tax ruling.
Hypothetical decision two: an imported client gift with a short deadline
Imagine a Korean company ordering branded desk items for business contacts in Istanbul. Its supplier proposes shipping individual parcels to recipients and labeling them “personal gifts” under a passenger allowance. The recipients are not passengers carrying their own noncommercial goods. The procurement lead rejects that assumption and asks the broker to assess the product, tariff classification, importer, value, permits and actual courier route under the commercial-import framework. The relationship owner separately checks the recipients' gift policies and whether any public procurement is active.
The marketing team wants a ten-day launch, but the supplier cannot confirm origin and product composition. The team has three genuine options: delay the international shipment for documentary review; source an equivalent item domestically after confirming the specification and supplier terms; or change to a nonphysical invitation that has its own tax, policy and privacy review. It should not pick the option by price alone. The domestic option may avoid importing that item, but it does not waive recipient-policy checks; the digital option still may transfer value and data. The decision owner documents cost, recipient experience, timing and residual risk for each.
Suppose the broker later finds a product-specific permission requirement. Operations holds the affected SKU before packing, updates recipients with a truthful revised date, and routes any replacement through the same policy and finance checks. If the gifts are declined, the contract determines return or credit; no one silently reassigns them to a public official. The acceptance packet contains the broker's dated classification and document decision, importer and charge allocation, recipient approvals, address-flow review, actual shipping or domestic purchase evidence and a reconciliation of exceptions. This is a hypothetical workflow, not a declaration that the proposed items have a particular duty rate.
Make the checklist executable
At intake, the request owner records purpose, recipient categories, countries, legal entity, expected volume, item specifications, budget and deadline. Before procurement, finance signs off on its classification and evidence needs; privacy counsel maps data and transfer; the relationship owner checks policy and conflicts; customs counsel or a broker signs off on the route if goods cross the border. The same person should not infer all four answers from a supplier quote. A missing answer has an owner and a due date, not a blank field disguised as approval.
Before invitation, test one eligible and one ineligible recipient, a decline, an incomplete address and a changed item. Verify that the notice appears at the right point, a recipient can make the intended choice, access is limited to necessary fields, and a hold prevents an unapproved shipment. Before dispatch, compare the order's actual item, value, importer and route to the approved version. After delivery, reconcile the carrier result and funding disposition, then ask the tax owner to review changes in actual value or acceptance. Record the retention/deletion event once the legitimate purpose and applicable obligations permit it.
Why the passenger gift figure is a poor shortcut
The Trade Ministry's June 2026 notice is about noncommercial goods accompanying a traveller. A company courier parcel has different facts: a seller, importer, consignor, product documents and commercial purpose. A shipping label that says “gift” does not recreate the traveller's situation. Ask the broker for the correct commercial or other applicable import route and keep the written reasoning with the campaign. If a person truly carries a noncommercial personal gift, assess those facts separately rather than turning them into a bulk-company shipping policy.
Conclusion: approve the facts, then execute the experience
The reliable order is to identify the recipient and item, separate employee value from business expense, map the personal-data flow, choose the domestic or import route, check acceptance policy and then release a versioned order. The traveller's allowance is a boundary example, not a reusable corporate parcel threshold. The strongest file shows who decided each question, what official or contractual source they used, what changed and how the actual recipient and shipment outcomes were reconciled. Local tax, legal, payroll, privacy and customs specialists remain responsible for their respective determinations.
For a program whose policy, taxes, data route and import model have been approved, Giftpack can help coordinate recipient choice and fulfillment and provide the applicable procurement and reconciliation information described in its pricing FAQ. The employer and its advisers still own the legal and commercial decisions. The global corporate gifting operations guide and global gift compliance hub offer further operating context across markets.
